NEOPTIX CANADA LP - WARRANTY DETAILS AND DISCLAIMER

The limited warranty set forth below is given by Neoptix Canada LP ("Neoptix"). The Neoptix product when delivered to you is warranted against defective materials or workmanship for a period of one (1) year from the date of purchase. Defective parts or a defective product returned to Neoptix and proven to be defective upon inspection, will be repair or exchanged for new parts or comparable rebuilt parts as determined by Neoptix.

This limited warranty does not cover any supplies or accessories as to which ther shall be no warranty or replacement.

This limited warranty covers all defects encountered in normal use of the product and does not apply in the following cases: Loss or damage to the product due to abuse, mishandling, improper packaging by you, alteration, accident, electrical current fluctuations, failure to follow operating instructions, maintenance and environmental instructions prescribed in Neoptix instruction manual or service performed by other than Neoptix. Such loss of or damage to the product includes, without limitation, water damage, damage from dropping the product, scratches, abrasions or damage to the connectors.

Dead on Arrival

All merchandise that is defective upon receipt will be replaced free of additional charge within reasonable delay of receipt of goods.

Repairs and service performed on non-Neoptix products

Products not originally manufactured by Neoptix but serviced or repaired by Neoptix in its Service Center are covered by a 90 days limited warranty. It has the same terms than the warranty offered on new products except for the duration.

Shipping damages

If you notice shipping damage upon delivery of goods to one or more of the boxes, please note the fact with the driver. Please contact  support@neoptix.com within 7 days of receipt of the damaged parcel. Once a claim has been made, Neoptix will work with the carrier to have the damaged goods picked up. We will arrange for repair or replacement of your product at no additional charge to you.

CUSTOM CONFIGURATIONS AND SPECIAL ORDERS

No returns or refunds will be made for items that are special ordered for you or for unusual custom configurations of systems without the written consent of Neoptix in each instance prior to purchase. Please consult a Neoptix service representative with questions.

LIMITATION OF LIABILITY

IN NO EVENT SHALL NEOPTIX BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, IN DIRECT, EXEMPLARY OR PUNATIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST REVENUE OR PROFITS, LOSS OF BUSINESS OR LOSS OF BUSINESS OPPORTUNITY, WHETHER OR NOT NEOPTIX HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. NEOPTIX’S LIABLITY SHALL BE LIMITED TO REPAIR OR REPLACEMENT, IN THE SOLE DISCRETION OF NEOPTIX, OF ANY PRODUCT. CUSTOMER AGREES THAT IN NO EVENT SHALL LIABILITY OF NEOPTIX EXCEED THE PURCHASE PRICE PAID BY CUSTOMER.

Errors and Omissions

Neoptix makes every effort to ensure the accuracy of the information published in our advertisements and on our web site. However, the documents and graphics published on this site may contain technical inaccuracies or typographical errors. Neoptix makes no representations about the suitability of the information and graphics presented on this site. All such documents and graphics are provided "as is" without warranty of any kind.

If an error is made and a product is listed at an incorrect price, Neoptix shall maintain the right to refuse or cancel any orders placed at the incorrect price. Products and packaging depicted may differ from stock available time of shipment.

Force Majeure (circumstances outside one’s control)

Neoptix will attempt to give you notice of any changes or delays to your order, but is not liable for damages resulting from delays beyond its reasonable control
